Application required Cashback Campaign Terms of Use

These Application required cashback campaign terms of use (these gTermsh) prescribe the terms and conditions for the provision of the cashback campaigns offered by JCB International Co., Ltd. (gJCBIh) for members of JCB branded cards issued outside of Japan (the gCampaignsh).
Customers shall be deemed to have agreed to these Terms by clicking the gAgree and Continueh button after confirming these Terms.
  1. Article 1Campaign contents and registration method
    1. The Campaigns are cashback campaigns provided by JCBI, and customers shall apply for the Campaigns via the website and system managed and operated by JCB Co., Ltd., the parent company of JCBI, in relation to the provision of the Campaigns (the gWebsite, Etc.h).
    2. JCB branded cards issued outside of Japan are subject to the Campaigns. Because some cards are not subject to each Campaign, please apply for the Campaigns after confirming the cards that are subject thereto and the other terms and conditions published on the JCB Special Offers website.
    3. Registration for participation in the Campaigns shall be completed when an applicant applies therefor after agreeing to these Terms and JCBI approves such application. If such participation registration has not been completed, please confirm any error message stated on the Website, Etc. In addition, when such participation registration has been completed, JCBI will send a registration completion email to the email address designated by the member.
    4. Customers may be unable to utilize the Campaigns if they are unable to register for participation due to an error in inputting their information, entering a card not subject to the Campaigns, or any other such negligence of the customer, or if they do not receive a registration completion email.
  2. Article 2Rejection of Campaign application and registration cancellation

    If any of the following events occur in relation to an applicant for Campaign participation registration or a Campaign registrant, JCBI may reject such Campaign registration application, or may restrict the use of all or part of the Campaigns or cancel the registration thereof without giving the applicant or registrant any prior notice, and JCBI shall not bear any obligation to disclose its reasons for doing so:

    1. if the applicant or registrant submits fraudulent information in connection with his or her Campaign application;
    2. if the applicant or registrant has breached any provision of these Terms; or
    3. if JCBI reasonably determines that there are other reasonable grounds to deem the usage registration inappropriate.
  3. Article 3Methods of cashback through the Campaigns
    1. Each customer must satisfy the campaign terms and conditions separately prescribed by JCBI in order to receive cashback through the Campaigns. The campaign terms and conditions shall be published on the JCB Special Offers website.
    2. Cashback may not be implemented if a customer falls under any of the following items:
      1. if any transaction involving a product or service is changed, canceled, or refunded, or deemed to have been made via any unauthorized use;
      2. if a customer cancel JCB branded card or has not established an account by the cashback date;
      3. if there are any changes to a customerfs card number in connection with the renewal or reissuance of the customerfs card by the cashback date;
      4. if the customerfs membership status has expired by the cashback date;
      5. if a settlement transaction was not executed during the period of the Campaigns due to any system trouble, etc.;
      6. if a customer did not pay with their JCB branded card directly at merchant subject to the Campaigns, but made a payment via a third party organization, such as a card-linked payment using a third party payment service; or
      7. if there was any error in inputting the customerfs card number at the time of the participation registration.
  4. Article 4Modification or cancellation of registered matters
    1. If there is an error in the information registered for the Campaigns and it is still within the registration period therefor, the customer must re-apply for the Campaigns on their own.
    2. Each customer may apply for the cancellation of the registered information within the registration period for the Campaigns by using the contact address stated in Article 14.
    3. No customer may modify or cancel their registered information outside of the registration period for the Campaigns.
  5. Article 5Prohibited acts

    Customers shall not engage in the following acts:

    1. acts that damage or inhibit the appropriate and timely function of the Campaigns, or that use hardware or software that is intended to secretly intercept any system, data, or personal information in relation to the Campaigns;
    2. acts that impose an unreasonable or disproportionately large load on the network of the Campaigns or other such infrastructure;
    3. acts that are likely to interfere with the operation of the Campaigns;
    4. acts that improperly access or attempt to access any network or system, etc. of JCBI or its affiliate companies;
    5. acts that impersonate a third party;
    6. acts that intentionally enter incorrect Campaign registration information;
    7. acts that cause any disadvantage, damage, or discomfort to other users of the Campaigns or other third parties;
    8. acts that infringe on the rules for using the Campaigns published on the Website, Etc.;
    9. acts that, directly or indirectly, provide benefits to any anti-social forces, etc.;
    10. acts that, directly or indirectly, evoke or facilitate any of the acts listed in the preceding items; and
    11. any other acts that JCBI reasonably determines to be inappropriate based on reasonable grounds.
  6. Article 6Change to, or suspension or end of, the Campaigns
    1. JCBI may change the contents of the Campaigns or end the provision thereof at its discretion. If JCBI changes or ends the Campaigns, JCBI shall notify customers thereof in advance by the method designated by JCBI.
    2. If JCBI falls under any of the following items, JCBI may, without giving any prior notice to customers, suspend or discontinue all or part of its provision of the Campaigns:
      1. if an inspection or maintenance work for the computer systems of the Campaigns must be urgently performed;
      2. if computers or networks, etc. have been disrupted due to an accident;
      3. if JCBI becomes unable to manage the Campaigns due to a force majeure event such as an earthquake, lightning strike, fire, storm or flood damage, electrical blackout, or other natural disasters; or
      4. any other cases in which JCBI determines it necessary to suspend or discontinue its provision of the Campaigns for reasonable grounds.
    3. JCBI reserves the right to modify, add, or delete any document, information, graphic, or other content displayed in connection with the Campaigns at any time and without notice.
  7. Article 7No warranty
    1. JCBI makes no warranty whatsoever that the Campaigns and the Website, Etc. (a) will conform to a specific purpose of a user, (b) will possess any anticipated functions, accuracy, or usefulness, and (c) will not suffer any malfunctions.
    2. The Campaigns or the Website, Etc. may not display correctly or operate properly depending on the usage or communication environment of a customer. Customers shall use the Campaigns and the Website, Etc. after confirming the necessary usage environment separately provided by JCBI.
  8. Article 8Ownership of rights

    All content published on the Website, Etc. (such as service names, information, trademarks, trade names, logos, service marks, photos, illustrations, designs, videos, and software) are protected by the copyrights, patent rights, trademark rights, or other such rights owned by JCBI and its affiliate companies or by third parties. It is prohibited by law to duplicate, convert, or change, etc. such content without the permission of the rights holders.

  9. Article 9Damage and disclaimer
    1. JCBI shall not be liable whatsoever for any kind of direct, indirect, special, exemplary, punitive, or consequential damage, or any other such damage (including, but not limited to, any property damage, loss of use or business, economic loss, or loss of data or profit that arises in relation to a payment in connection with the customerfs access to the Campaign pages or participation in a cashback campaign), regardless of the form of action thereof (including, but not limited to, torts). However, this shall not apply in cases of willful misconduct or gross negligence on the part of JCBI.
    2. JCBIfs liabilities against customers, whether with respect to contract, tort, or otherwise, for any and all damage, loss, and counts arising pursuant to the use of the Campaigns shall not exceed the lower of either the amount paid by the customer (if applicable) or 10,000 yen. However, this shall not apply in cases of willful misconduct or gross negligence on the part of JCBI.
    3. Each customer shall indemnify, defend, and hold harmless JCBI and its business partners, employees, and affiliate companies from and against any costs (including reasonable attorney fees), liabilities, losses, or claims that arise in relation to the customerfs breach of these Terms, any impediments to the use of the Campaigns due to the communication environment, registration participation for a non-applicable Campaign, any dispute with a supplier due to the customerfs participation in the Campaigns, or the use of the Campaigns by the customer. However, this shall not apply in cases where such costs, liabilities, losses, or claims arose as a result of the willful misconduct or gross negligence of JCBI.
  10. Article 10Handling of customer personal information

    JCBI shall handle any customer personal information it acquires in connection with the Campaigns in accordance with the guidelines set out in the document titled gHandling of Personal Information in the JCB Cashback Campaignh.

  11. Article 11No assignment

    No customer may assign, transfer, or provide as security to a third party, or otherwise dispose of, the customerfs contractual status, nor any of the customerfs rights or obligations, under these Terms.

  12. Article 12Governing law and jurisdiction

    These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction in the first instance for any and all disputes arising out of or in connection with these Terms and the provision of the Campaigns.

  13. Article 13Change to these Terms
    1. JCBI may change these Terms after prescribing a certain notice period therefor.
    2. Any change to these Terms shall be published on the gNoticeh page of the JCB Special Offers website and shall become effective at the time when such publication is made.
  14. Article 14Inquiries concerning the Campaigns

Neither JCBI nor JCB itself issues any type of credit card, debit card, check, or settlement card in any region other than Japan. Any JCB branded cards of the customer were issued by a local bank or financial institution, and no customer has any direct relationship with JCB or JCBI due to their ownership of a JCB branded card. Any inquiries or issues concerning a customerfs JCB branded card or a card holderfs account (excluding inquiries concerning the Campaigns) should be submitted to the bank or financial institution that issued the card in question, not JCBI or JCB. Any terms or conditions in an agreement between a JCB branded card holder and the bank or financial institution that issued such card will not be effective with respect to, or have any relation to, these Terms.

Handling of Personal Information in the JCB Cashback Campaign

JCB International Co., Ltd. (the gCompanyh) processes personal information within the following scope in accordance with applicable personal information protection laws and regulations of each country where customers are located in order to provide a cashback campaign for holders of JCB branded cards (the gCampaignh). Brand privacy policies stated in Clause 9 below exist for some countries where customers are located, and the Brand privacy policy in question will apply as long as it does not conflict with these details concerning handling of personal information in the JCB Cashback Campaign (this gCampaignh). Customers must apply for this Campaign upon accepting the terms of use of the Campaign in addition to this Handling of Personal Information in the JCB Cashback Campaign (the gPolicyh).

  1. Information collected, held, used, and entrusted by the Company

    The Company collects the following personal information from applicants for the Campaign via the Internet or telephone.

    1. Information that the customer registers in the application for the Campaign: Email address and card number
    2. Information regarding the customer or payment information that the customer registers when cancelling, or requesting details about, participation in the Campaign
    3. Information regarding the customer or payment information that the customer registers when making an inquiry concerning the Campaign

      In addition, the Company collects the following information from merchants of JCB branded cards.

    4. The customerfs card transaction information: Transaction information, such as card numbers, name and location of the merchant, transaction date, and total amount of the transaction

    In principle, the Company does not collect names, addresses, phone numbers, or other similar information through the Campaign. However, the Company might collect a customerfs name and phone number if, and only if, it is necessary to do so for the purpose of responding to inquiries from the customer.

  2. Purpose of use
    1. The Company might use a customerfs personal information for the following purposes:
      1. For implementation of the Campaign
        • To process cashback procedures for a person who satisfies the cashback terms and conditions of the Campaign
        • To contact a registrant of the Campaign
        • To process requests for details regarding information registered for the Campaign, or to conduct procedures for cancellation of registration with the Campaign
      2. For marketing analysis regarding the use of JCB branded cards (including for measurement of the Campaignfs effectiveness)
      3. For improvement of product and service quality, and development of new products and services
  3. Legal basis for processing

    The Company processes each customerfs personal information in accordance with the legal basis stipulated under applicable personal information protection laws and regulations (such as consent of the data subject, performance of contractual obligations, legitimate interests, or compliance with laws and regulations).
    The provision of a customerfs personal information might be mandatory as a statutory or contractual requirement, as a necessary condition for entering into a contract, as a necessary condition for the customerfs receipt of the provision of the Campaign, or for other reasons. Specifically:

    • The provision of an email address and a card number is necessary for identity confirmation when applying for the Campaign and for notification of the result of such application. If the customer does not provide such information, the Company might not be able to provide a cashback through the Campaign.
    • The provision of registered information regarding the customer or payment information is necessary for responding in instances of cancellation, requests for information, or inquiries, in relation to the Campaign. If the customer does not provide such information, the Company might not be able to respond to such inquiries, etc.
    • The customerfs card transaction information is necessary for confirmation of the satisfaction of cashback terms and conditions for, and implementation of, a cashback in the Campaign. If the customer does not provide such information, the Company might not be able to provide a cashback through the Campaign.
  4. Retention period for personal information

    If the Company uses a customerfs personal information for the purposes described in Clause 2 (i) above, the Company will retain such personal information until implementation of the cashback for the customer through the Campaign is completed. If the Company uses a customerfs personal information for the purposes described in Clause 2 (ii) or (iii) above, the Company will retain such personal information for up to 25 months starting from the end date of the registration period for participation in the Campaign.

  5. Method for sharing personal information; provision and data transfer of personal information
    1. The Company might share with the following entities personal information and anonymized personal information collected for the purposes described above.
      1. For implementation of the Campaign
        • Shared with: JCB Co., Ltd.
        • Information shared: Registered card numbers and email addresses
      2. For marketing analysis regarding the use of JCB cards
      3. For improvement of product and service quality, and development of new products and services
        • Shared with: JCB Co., Ltd., and JCB overseas bases responsible for areas where card products have been issued
        • Information shared: Anonymized card number and transaction information
    2. In addition, the Company will also provide a customerfs personal information to a third party in the following cases.
      • When, for the purpose of subcontracting tasks related to the Campaign operations, the Company provides the minimum necessary amount of information to a subcontractor that has covenanted to protect personal information;
      • When receiving an inquiry pursuant to laws and regulations from a public institution
      • When otherwise permitted by applicable laws and regulations
    3. The Company stores personal information and anonymized personal information collected for the purposes described above in a server located in Japan.
  6. Security

    The Company takes reasonable physical, technical, organizational, and procedural measures to protect personal information within the Companyfs organization against loss or theft and against unauthorized use, disclosure, or modification. If the Company subcontracts the processing of personal data to a subcontractor, the Company will appropriately supervise such subcontractor.

  7. Rights and options of customers

    Depending on the country where a customer is located, the customer might be granted the following rights, among others, in relation to personal information: right of disclosure; right to access; right to rectify; right to erase; right to restrict processing; right to object to processing; right to withdraw the customerfs consent; right to refuse processing for advertising or promotional purposes; right of self-defense; right of data portability; right not to be subject to automated decision-making; and right of disclosure of reasons for denial of the exercise of rights. For example, the Act on the Protection of Personal Information of Japan grants the right to request the following in relation to personal information: notification of the purpose of use; disclosure; correction, addition, or deletion of content; suspension of use, erasure, or suspension of third-party provision; and disclosure of records of third-party provision. If a customer intends to exercise any of these rights, he or she is requested to make an inquiry using the contact address stated in Clause 8 below.
    If there is an error in registered personal information within the registration period for the Campaign, the customer in question might be requested to re-register for the Campaign by himself or herself. The customer may apply to cancel registration of participation using the contact address stated in Clause 8 below.
